General Terms and Conditions of Sale

Article 1: Purpose

These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) define the conditions applicable to transactions carried out on the website www.bulles-bonheur.com, operated by the company SARL LES BULLES D’ÉLODIE ET FABRICE. They govern the online sale of products, reservations for services (spa, restaurant, Champagne bar), and other services provided to customers (hereinafter referred to as “Customer”).

By using the website and placing an order or reservation, the Customer fully accepts these GTCS.


Article 2: Legal Information

The following provisions set out the general terms and conditions of sale for the products offered by the company SARL LES BULLES D’ÉLODIE ET FABRICE on its website: www.bulles-bonheur.com.

SARL LES BULLES D’ÉLODIE ET FABRICE is a Limited Liability Company with a capital of 10,000 €, whose registered office is located at 71 Avenue de Champagne, 51200 ÉPERNAY, FRANCE, and registered with the Reims Trade and Companies Register under number 824255822.

The legal representative of the company is Mr. Fabrice Spreux, Manager.

These general conditions aim to regulate the contractual relationship between SARL LES BULLES D’ÉLODIE ET FABRICE (hereinafter referred to as “SARL LES BULLES D’ÉLODIE ET FABRICE” or “the Seller“) and any person making a purchase or reservation through the website www.bulles-bonheur.com (hereinafter referred to as “the Buyer“).

By becoming a client or user of the website, joining SARL LES BULLES D’ÉLODIE ET FABRICE implies the acceptance of these General Terms and Conditions of Sale (GTCS) without reservation. This acceptance is confirmed by checking a box before confirming any order or reservation.

The Seller reserves the right to modify these GTCS at any time. The applicable terms are those in effect at the time of the order or reservation placed by the Buyer.

Article 3: Products and Services

The website offers the following services:

  1. Online sale of Champagne: selected Champagne bottles, gift boxes, and other related products.
  2. Online reservations :
    • Spa: wellness treatments, massages, access to specific equipment.
    • Restaurant: table reservations and discovery of available menus.
    • Champagne bar: tasting reservations and visits.
  3. Private or corporate events: organization by quote (contact via the site).

The products offered for sale are described with the greatest care. The photographs and visuals are non-contractual.

The Buyer declares that they have the legal capacity to place an order or make a reservation, meaning they are of legal age or have parental or legal authorization.


Article 4: Price and Payment Terms

4.1 Product and Service Prices
The prices displayed on the website are in euros (€), including all taxes (VAT), excluding any potential delivery and reservation fees. Additional fees will be specified before confirming the order.

The company LES BULLES D’ÉLODIE ET FABRICE reserves the right to modify its prices at any time, while ensuring that the Buyer is charged the price in effect at the time of the order.

Unless otherwise agreed between the parties, payment is due at the time of the order. No discount will be granted for early payment. In accordance with legal provisions, any payment made after the due date stated on the invoice will incur late payment penalties amounting to three times the legal interest rate. These penalties are due without the need for a reminder. Additionally, late payment will result in a fixed fee of 40 € for collection costs for sales made to professional clients.

4.2 Payment methods
Payment is made online using secure methods:

  • Credit card (Visa, Mastercard, etc.)
  • Bank transfer
  • Any other solution indicated on the site.

Payment is due in full at the time of the order or reservation.

4.3 Payment Security
The site uses SSL encryption technology to secure all transactions made on our site, ensuring the confidentiality of your bank details. In case of suspected fraud, SARL LES BULLES D’ÉLODIE ET FABRICE reserves the right to block the order and request further information for verification.


Article 5: Orders and Reservations

5.1 Product Orders (Champagne)
The Customer selects the products of their choice and confirms the order after reviewing the details. The order is considered final only after payment confirmation. An email confirming the order will be sent to the Customer.

5.1.1 Placing and Preparing the Order.
The order is placed only on www.bulles-bonheur.com. The Buyer declares and guarantees having the legal capacity to place an order on www.bulles-bonheur.com. The Buyer certifies, at the time of the order, being at least 18 years old or having legal authorization in their country to make a purchase on www.bulles-bonheur.com.

The Buyer also guarantees that they are fully authorized to use the provided credit card for the transaction and that it is not being used fraudulently. The Buyer also commits to ensuring that the card has sufficient funds to cover the purchases. Any purchase made on www.bulles-bonheur.com will be considered to have been made by the account holder. All data recorded by Bulles et Bonheur constitutes proof of transactions made by the Buyer on www.bulles-bonheur.com.

The order is validated only when the Buyer has clicked twice, in accordance with the French Digital Trust Law of June 21, 2004: once to place the order and again to confirm it. The confirmation constitutes signature and acceptance of the operations carried out.

Once the order is received, it becomes irrevocable. A confirmation email is sent, subject to full payment. A second email will be sent to the Buyer when the products are dispatched, along with a tracking number, depending on the carrier. The Customer specifies the payment method (credit card or bank transfer).

5.1.2 Product Availability
Despite all the precautions taken, an ordered product may be unavailable. In the event that a product is unavailable before its shipment, the Seller commits to fulfilling the order within the limits of available stock. In case of stock depletion, the Seller will offer the Customer a product of equivalent quality and price. If no agreement is reached, and in case of the Customer’s withdrawal, the Seller will proceed with a refund under the conditions of Article L 121-20-1 of the Consumer Code

5.2 Online Reservations

  • The Customer may book a slot for spa, restaurant, or Champagne bar services through an online module
  • A reservation confirmation is sent by email after validation.
  • In case of cancellation, the conditions provided in Article 6 apply.

5.3 Retention of Ownership

In accordance with Article L 624-16 of the Commercial Code, goods remain the property of SARL LES BULLES D’ÉLODIE ET FABRICE until full payment is made.


Article 6: Cancellation and Refund Policy

6.1 Products (Champagne)
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to the following products:

  • Products that are perishable or deteriorate quickly.
  • Products opened by the Customer after delivery that cannot be returned for reasons of hygiene or health protection.
  • Personalized or custom-made products

Therefore, no returns or refunds will be accepted after receiving the products, except in cases of:

  • Defective product: if the product received is damaged or does not conform to the order. In this case, the Customer must contact LA SARL LES BULLES D’ÉLODIE ET FABRICE within 48 hours of receipt, providing supporting photos.
  • Order error: if the product delivered does not correspond to the order placed.

For any complaints, the Customer can write to contact@bulles-bonheur.com, including their order number.

6.2 Reservations (Spa, Restaurant, Champagne Bar)

  • Free cancellation: Reservations can be canceled or modified free of charge up to 48 hours before the scheduled date and time.
  • Late cancellation or no-show: Any cancellation made less than 48 hours before the service, or in the event of a no-show, will result in the full amount of the reservation being charged.

Force majeure: In case of force majeure (illness, accident, etc.), free cancellation may be granted upon presentation of a valid justification.

6.3 Right of Withdrawal

Non-professional clients have 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties. The client must inform the Seller of their decision to withdraw in writing by email to contact@bulles-bonheur.com before returning the goods. They will also bear the return shipping costs and ensure the proper return of the goods.

They may do so by using the standard form available below (creating a PDF file attached with the text from Decree No. 2014-1061 of September 17, 2014).

Or by filling out and submitting the withdrawal form online on our website www.bulles-bonheur.com. In this case, the Seller will promptly send the Customer an acknowledgment of receipt of the withdrawal on a durable medium.

By exception, these provisions will not apply to orders placed by a client acting in the context of their professional activity, nor to orders for products that have been personalized or specifically requested by the customer during the order (special format, personalized packaging, etc.).

Refunds for the product will be made within 14 days from the receipt of the returned items but will cover only the product cost. Initial shipping costs are not refunded unless there is an error on the part of SARL LES BULLES D’ÉLODIE ET FABRICE. The return should be sent to the following address: SARL Les Bulles d’Elodie et Fabrice, 71 Avenue de Champagne 51200 EPERNAY, FRANCE. The Customer will bear the responsibility for the return process


Article 7: Delivery, Receipt, and Storage of Products

7.1 Delivery Tracking and Receipt
When your order is shipped, you will receive a tracking number that allows you to follow your parcel’s journey with the carrier. A signature will be required upon receipt of the parcels, so it is essential that someone is present to accept the delivery.

We recommend checking the condition of your parcel and its contents immediately upon receipt. In case of any anomalies (damaged parcel, missing or incorrect item), please immediately make the usual reservations with the delivery person and contact us as soon as possible. If you received the wrong item, please send us photos of the received item so our team can evaluate your request and advise you on the next steps.

7.2 Delivery Methods and Times
Orders are shipped by:

  • Colissimo: for orders of 1 to 12 bottles.
  • MBE (Mail Boxes Etc.): for orders exceeding 12 bottles.

SARL LES BULLES D’ÉLODIE ET FABRICE commits to shipping the customer’s order within a maximum of 10 working days, excluding specific areas. If this deadline is exceeded, the customer may request a full refund of the order, in accordance with Article L.121-20-1 of the French Consumer Code.

International delivery times depend on the destination country and are provided as an estimate.

7.3 Delivery Address
If the delivery address differs from the billing address, it is essential to specify this during the order process. Once the order is confirmed, the information provided (address, product, quantity) is immediately sent to our logistics provider and cannot be changed.

7.4 Delivery Delay
We commit to delivering your order within 10 working days for mainland France, excluding specific areas (high mountain regions, etc.). In the event of a delay beyond this period, the Customer may request a refund of their order, in accordance with the provisions of Article L.121-20-1 of the French Consumer Code.

7.5 Geographical delivery area
Products can only be delivered in mainland France, including Corsica.

7.6 Transfer of Risks
The transfer of risks related to the products occurs as soon as they are handed over to the carrier. The Customer becomes responsible for the products from that point onward.

7.7 Transport and Reservations
In case of damage, defects, or missing products, the recipient must issue written and precise reservations to the carrier within 3 working days, by registered letter with acknowledgment of receipt, in accordance with Article L.133-3 of the French Commercial Code. A copy of this letter must also be sent simultaneously to our customer service.

Without reservations issued, the parcel will be considered accepted, and our liability will be excluded.

7.8 Product storage
For optimum preservation, we recommend storing cartons and bottles :

  • Away from light, freezing temperatures, and excessive heat.
  • In an environment with a constant temperature lower than 18°C and stable humidity.
  • Away from organohalogenated, chlorinated products, or any substances containing volatile compounds that could harm the wine.

In the case of wine deterioration, the Customer must keep the affected bottle and contact our customer service through the “Contact” section of the website (www.bulles-bonheur.com) or by email at contact@bulles-bonheur.com. The bottle may be analyzed to determine the cause of the deterioration.

7.9 Additional charges for rescheduling delivery
For orders over 12 bottles, a new delivery appointment will incur additional charges:

  • €25 (incl. tax) for 12 to 60 bottles.
  • €45 (incl. tax) for more than 60 bottles.

Article 8: Liability

SARL LES BULLES D’ÉLODIE ET FABRICE cannot be held responsible for the non-performance or improper performance of an order or service due to a force majeure event or the unforeseeable actions of a third party.

For bookings, the Customer is responsible for the information provided (time slots, number of participants, etc.).


Article 9: Personal Data Protection

SARL LES BULLES D’ÉLODIE ET FABRICE takes all necessary measures to protect its customers’ personal data. This website complies with and respects the GDPR provisions within its capabilities, in accordance with Article 27 of Law No. 78-17 of January 6, 1978, “Informatique et Libertés.” The data collected during orders and reservations are used exclusively for transaction processing and customer relations.
In accordance with the GDPR, the Customer has the right to access, correct, and delete their personal data by writing to contact@bulles-bonheur.com.


Article 10: Intellectual Property

All content available on the website (texts, images, logos, etc.) is the exclusive property of SARL LES BULLES D’ÉLODIE ET FABRICE. Any reproduction, even partial, is strictly prohibited without prior authorization.


Article 11: Cookies

Failing that, the competent courts will be those located within the jurisdiction of the registered office of SARL LES BULLES D’ÉLODIE ET FABRICE.


Article 13: Protection of Minors

In accordance with Article L.3342-1 of the French Public Health Code, which prohibits the sale of alcohol to minors, the customer and the recipient agree to be at least 18 years old at the time of ordering or of legal age in their country.
